How to obtain a building permit?


For which interventions do we need a building permit?
 - A building permit is required for a new construction (including extensions and additions), a reconstruction and a change of building's purpose or its removal. The permit has to be obtained for demanding, less demanding and undemanding facilities, although the procedures for obtaining a building permit for undemanding facilities is greatly simplified. Undemanding facilities are, among others: woodsheds, garages, glasshouses, swimming pools, closed septic tanks, shorter access roads, fences, escarpments, etc.

- A building permit is not required for simple structures (such as: canopies, gas or oil tanks, small treatment plants, rainwater reservoirs, made-up courtyard (up to 300 m2), sound barriers, apiaries, field paths, temporary facilities, training facilities, memorials, urban equipment, etc.). Construction of simple facilities is permitted provided that the investor has the right to build on the given land that the construction is not in conflict with the spatial planning documents and that all the conditions and requirements for a simple facility construction are met, such as the Decree on facility types regarding their complexity.

- The new Construction Act eliminates two administrative orders: the notification of works and the location permit. The term investment maintenance work has been introduced, for which one also doesn't need to obtain a building permit. Among such works are: setting up of an electric generator, heating installation, installation of solar collectors or solar panels, heat pump installation, drilling a hole for geo-probe, installation of air conditioning system, installation of skylight windows, etc.

The procedure to obtain a building permit remains quite challenging also under the new law!

 - We obtain the location information – issued by the municipality (form for Ljubljana is available at http://ppmol.org/urbanizem4/mainpager.php?get=87).
 - We produce the urban part of the project to obtain the building permission (leading file).
 - We produce the project to obtain the building permit and the realisation (architecture, installations).
 - We obtain approvals for the project to obtain the building permission.
 - We obtain a calculation of the communal tax.
 - We prepare application for the Administrative unit to obtain a building permit.

The new Decree on the area to determine the parties in the process of issuing a building permit states a band of parties under uniform formulas to exactly calculate the zone of lots whose owners are parties in the process of obtaining a building permit.
